As a result of the 7-to-2 decision, Jewish and Christian Sabbath-observers have been unable over the past 40 years to enforce accommodation to Sabbath-observance and other religious practices that the law prescribes.

“The Bible not only doubly emphasizes that ‘justice, justice shall you pursue,’ (Deut. 16:20),” said Rabbi Dov Fischer, West Coast Regional VP of the CJV, “but it also enjoins us to avoid peddling in unsubstantiated rumors. (Lev. 19:16)”

The conservative Coalition for Jewish Values enthusiastically congratulated Kavanaugh on his confirmation, decrying his opponents for having “attempted to deny him basic civil standards such as the presumption of innocence and the right to due process” in a statement.

Despite media reports that the ceremony was a “victory lap” for President Donald Trump, Rabbi Menken told The Jewish Week that “it didn’t feel that way.” Instead, he said, those in attendance were there to support Kavanaugh and his family and “those who fought for him.”

“Unless there is something tangible, we will stick by our original statement of support… One cannot destroy a family and reputation based on allegations,” Rabbi Pesach Lerner, president of CJV, wrote in an email to The Jewish Week.

The CJV stated that to abandon previous evaluations of Judge Kavanaugh based solely upon uncorroborated testimony would violate both Biblical and accepted modern standards for evidence — and basic fairness as well.
